Collection of personal data when downloading the app
When downloading the mobile app, the required information is transferred to the App Store, i.e. in particular user name, e-mail address and customer number of your account, time of download, payment information and the individual device identification number. We have no influence on this data collection and are not responsible for it. We process the data only insofar as it is necessary for downloading the mobile app to your mobile device.
Collection of personal data when using the app
Inevitably, we can only make the benefits of our app available to you if we collect certain personal data about you that is necessary for the operation of the app when you use it. We only collect this data if this is necessary for the fulfilment of the contract between you and us (Art. 6 para. 1 s. 1 lit. b GDPR). Furthermore, we collect this data if this is necessary for the functionality of the app and if your interest in the protection of your personal data does not outweigh this (Art. 6 para. 1 s. 1 lit. f GDPR).
We collect and process the following data from you:
Device information: This includes IP address, device ID, device type, device-specific settings and app settings as well as app properties, date and time of retrieval of the app, time zone, amount of data transferred and the message whether the data exchange was complete, occasions of app crashes and the used operating system. This data is processed to technically enable the operation of the app.
Data that you provide to us: To use the app, you need to create a user account. For this purpose, you must enter your email address and set a safe password.
If you contact us by e-mail, then your e-mail address, name and any other personal data you have provided in the course of contacting us will be stored by us so that we can contact you to answer the question.
On a voluntary basis, you may provide the following additional information as part of the registration process or when using the app:
First name, last name, username, profile picture and your cell phone number,
Location Data: For the purpose of providing the service of WyLD, we collect your location data on a voluntary basis using GPS (location data accurate to the meter). At the beginning of the use of the app and at certain intervals during the use of the app, we ask for your permission to use this location data. If you do not want to give us this permission, we will not access or use the location data. In this case, you will still be able to use the app in a limited way. You can grant or revoke permission at any time later in the settings of your end device. Your location data will only be transferred to us if you have activated the app. It will not be used by us to create movement profiles beyond your current location.
You can revoke the voluntary information at any time with effect for the future by deleting the relevant information in your profile.
We use the data listed in sections 2 and 3 solely for the purpose of enabling you to use the app.
Data processing by third parties – processing within Art. 28 GDPR
It may happen that contracted service providers are used for individual functions of our app. We use external domestic and foreign service providers to process our business transactions (e.g. for the areas of IT, telecommunications, sales and marketing). These service providers only act on our instructions and are contractually obligated to comply with the data protection provisions pursuant to Art. 28 GDPR.
The following types of recipients may receive access to your personal data:
Service providers for the operation of our app and the processing of data stored or transmitted by the systems (e.g. for data centre services, payment processing, IT security). The legal basis for the transfer is then Art. 6 para. 1 s. 1 lit. b or lit. f GDPR;
Government agencies/authorities, insofar as this is necessary to fulfil a legal obligation. The legal basis for the disclosure is then Art. 6 para. 1 s. 1 lit. c GDPR;
Persons employed to carry out our business operations (e.g. auditors, banks, insurance companies, legal advisors, supervision authorities, parties involved in company acquisitions or the establishment of joint ventures). The legal basis for the disclosure is then Art. 6 (1) sentence 1 lit. b or lit. f GDPR.
In addition, we will only disclose your personal data to third parties if you have given your express consent to do so in accordance with Art. 6 (1) p. 1 s. 1 lit. a GDPR.
Transfer of personal data to third countries
In the course of our business relationships, your personal data may be transferred or disclosed to third party companies. These may also be located outside the European Economic Area (EEA), i.e. in third countries. Such processing takes place exclusively for the fulfilment of contractual and business obligations.
Data storage period
We delete your personal data as soon as it is no longer required for the purposes for which we collected or used it. As a rule, we store your personal data for the duration of the usage or respectively the duration of the contractual relationship via the app.
However, storage may take place beyond the specified time in the event of a (threatened) legal dispute with you or other legal proceedings.
Legal requirements for the storage and deletion of personal data remain unaffected by the above (e.g. § 257 German Commercial Code (Handelsgesetzbuch, “HGB”) or § 147 German Tax Code (Abgabenordnung, “AO”)). If the storage period prescribed by the statutory provisions expires, the personal data will be blocked or deleted unless further storage by us is necessary and there is a legal basis for this.
Data security
To ensure data security and the protection of your personal data, we take technical protective measures, in particular to prevent third parties from accessing your data. We adapt the technical protective measures according to the current state of the art.
Your rights
You have the right to information about the personal data stored by us about you and, if necessary, a right to correction, deletion or blocking of this data. In addition, you have a right to restrict the processing of personal data. You may also revoke your consent to the processing of your data at any time. You have the right to receive the personal data concerning you from us in a structured, common and machine-readable format and the right to have this data transferred directly to another controller, insofar as this is technically feasible. To assert your rights, please contact the responsible person named in section 1.
You can view and change the data stored in your profile at any time. Likewise, you can delete your profile at any time. In the cases of § 35 para. 3 German Federal Data Protection Act (Bundesdatenschutzgesetz, “BDSG”), the deletion is replaced by the blocking.
You also have the right to complain to a data protection supervision authority about the processing of your personal data in our company.
We would like to point out that we are entitled to provide information about data in individual cases by order of the competent authority, insofar as this is necessary for the purposes of criminal prosecution, for the prevention of danger by the police authorities of the federal states, for the fulfilment of the statutory tasks of the federal and state authorities for the protection of the constitution, the Federal Intelligence Service or the Military Counter-Intelligence Service or for the enforcement of intellectual property rights.
Changes
In the course of further technical development, we will also continuously adapt the privacy policy. We will incorporate any changes on this page in due time and, where necessary, obtain your renewed consent.
